Valentines.com Seller Terms and Conditions

Welcome to Valentines.com! These Terms and Conditions ("Terms") govern your use of Valentines.com’s platform as a seller. By registering as a seller, you agree to these Terms in full. If you do not agree to these Terms, you may not register or sell on Valentines.com.

1. Acceptance of Terms

By completing the registration process, you acknowledge and agree to be bound by these Terms, Valentines.com’s Privacy Policy, and all applicable laws and regulations. Valentines.com reserves the right to update these Terms at any time without prior notice. Continued use of the platform constitutes your acceptance of any changes.

2. Eligibility

To register as a seller on Valentines.com, you must:

  • Be at least 18 years old.
  • Provide accurate and complete information during registration.
  • Comply with all applicable laws and regulations related to your business.

3. Seller Responsibilities

As a seller on Valentines.com, you agree to:

  1. Profile Setup: Complete your profile accurately, including shipping policies, return policies, and product information, as described in the Seller Configuration Guide.

  2. Product Listings: Ensure all product descriptions, images, pricing, and inventory details are accurate, lawful, and not misleading. Each listing will be reviewed by Valentines.com prior to approval.

  3. Shipping:

    • Clearly define and configure your shipping method (e.g., Free Shipping or ShipStation Shipping).

    • Ensure timely fulfillment of customer orders in compliance with your stated shipping policies.

  4. Customer Service: Address customer inquiries and resolve disputes promptly and professionally.

  5. Compliance: Abide by all applicable laws, including tax regulations, and ensure your products are safe and lawful to sell.

  6. Content Ownership: Only upload content (e.g., images, text) that you own or have permission to use.

4. Fees and Payments

  1. Valentines.com charges a 15% commission on the product price of each sale.

  2. A transaction fee of 2.7% + $0.30 applies to each order for online credit card processing.

  3. For sellers using ShipStation, the shipping fee is charged to the customer and retained by Valentines.com to cover the cost of the UPS label.

  4. Disbursements are made weekly to accounts with a balance over $100. Ensure your payment details are accurate under Profile > Payment Details.

5. Sales Tax

  • You are responsible for collecting and remitting sales tax in any state where you have nexus unless otherwise noted.
  • Valentines.com will collect and remit sales tax for customers in states where Valentines.com holds nexus.

6. Prohibited Items

The following products are prohibited on Valentines.com:

  • Illegal or counterfeit goods.
  • Hazardous materials.
  • Any products violating intellectual property laws or Valentines.com’s policies.

Valentines.com reserves the right to remove prohibited listings and suspend or terminate seller accounts.

7. Termination

Valentines.com reserves the right to suspend or terminate your seller account at any time for violating these Terms or engaging in fraudulent or harmful activities.

8. Limitation of Liability

Valentines.com is not liable for:

  • Lost sales due to platform outages or other technical issues.
  • Shipping delays, damages, or losses caused by third-party carriers.
  • Legal or financial issues arising from your sales activities.

Your sole remedy for dissatisfaction with the platform is to discontinue use.

9. Indemnification

You agree to indemnify and hold harmless Valentines.com, its affiliates, and employees from any claims, damages, or expenses arising from your use of the platform, breach of these Terms, or violation of any laws.

10. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of New Jersey.
